Terms of Service

1. The service

EPEX Build (“the service”) is a construction project management platform operated by EPEX Technology (“we”, “us”). A workspace subscription gives your company (“you”) access to project scheduling, budgeting, draw management, e-signature packaging, field tools, and owner portals for the projects you create in your workspace.

2. Accounts & workspaces

You sign in with a magic link sent to your email; you are responsible for keeping access to that inbox secure. The person who creates a workspace becomes its administrator and may invite team members, owners, and subcontractors. You are responsible for the people you invite and for the accuracy of the data your workspace stores.

3. Trials, plans & billing

New workspaces get a 30-day free trial with no payment method required. After the trial, continued access requires an active subscription on one of the published plans. Subscriptions are billed monthly or yearly in advance through Stripe, our payment processor; we never see or store your full card details. Plan limits (active projects, team seats) are enforced by the service. You can cancel at any time from the billing portal — access continues to the end of the paid period, and we don’t give prorated refunds for partial periods.

If a renewal payment fails we keep your workspace accessible for a grace period while Stripe retries the card. If the subscription lapses entirely, access to the workspace is suspended but your data is not deleted — access resumes the moment a plan is active again.

4. Your data

Everything you put into your workspace — projects, budgets, draws, documents, photos — is yours. We host it and back it up, and we access it only to operate and support the service. You can export your data (CSV) at any time, and you can request deletion of your workspace by contacting us. See the Privacy Policy for details on what we collect and how it’s protected.

5. E-signature & financial documents

The service can assemble draw packages and route documents for electronic signature through third-party e-signature providers. You are responsible for reviewing every document before sending it and for the legal sufficiency of any document you execute. The service produces paperwork; it does not provide legal, accounting, or lending advice.

6. Acceptable use

Don’t use the service to store or transmit unlawful material, to infringe others’ rights, to probe or disrupt the service’s security, or to access data that isn’t yours. We may suspend accounts that do.

7. Availability & changes

We work to keep the service available and fast, but it is provided “as is” without warranties of uninterrupted or error-free operation. We may improve or change features over time; if we ever discontinue the service we will give you at least 60 days’ notice and a way to export your data.

8. Liability

To the maximum extent permitted by law, our total liability for any claim arising out of the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential damages, including lost profits, delays on your projects, or disputes with your owners, lenders, or subcontractors.

9. Changes to these terms

We may update these terms as the product evolves. For material changes we’ll notify workspace administrators by email at least 14 days before they take effect. Continuing to use the service after that means you accept the updated terms.
